USING MEDIATION TO ADDRESS COMPLEX CIVIL DISPUTES
For parties engaged in civil disputes, pursuing litigation may not be the most cost-effective or efficient manner to handle conflicts. At Pakis, Giotes, Burleson & Deaconson, P.C., we have helped individuals and business owners address matters through mediation.
Our attorneys have decades of combined experience facilitating alternative dispute resolution (ADR) proceedings in Texas. All of our lawyers are capable of serving as third-party neutrals in all types of cases appropriate for mediation. In addition, attorneys Jim Hering are certified mediators.
Whether your legal conflict is personal or commercial in nature, we have the training and experience necessary to guide you through mediation and obtain an optimal result.
UNDERSTANDING THE STEPS INVOLVED WITH MEDIATION
The mediation process is not as formal as is litigation or arbitration. However, these sessions follow a structure that includes an introduction to the mediation process and guidelines. Each party is given an opportunity to explain his or her side of the conflict and meet with the mediator privately to discuss available options. Meditation sessions successfully conclude when the mediator identifies an acceptable solution and each party signs the agreement detailing the terms.
BENEFITS ASSOCIATED WITH THIS APPROACH
Clients we have represented in mediation have appreciated the advantages associated with this form of alternative dispute resolution (ADR). Unlike litigation, mediation allows parties:
To keep their matters private
To retain control over the decision-making process
To save time and money
To talk directly to the other party
When you are engaging in mediation to resolve a complex dispute, it is critical to work with a well-informed professional. You can depend on our lawyers to prepare you for your session so that you are positioned to succeed.
